What KRiBSI can do

What it is

Komisja Rozwoju i Bezpieczeństwa Sztucznej Inteligencji (Commission for the Development and Safety of Artificial Intelligence) supervises the market for AI systems and general-purpose AI models in Poland under the EU AI Act. The substantive duties come from the EU regulation; the act sets up the supervisor and its procedures.

Legal basis: Art. 1 · Dz.U. 2026 poz. 1003

Who sits on it

The chair, two deputy chairs and four members designated by the President of UOKiK (competition and consumers), the Polish Financial Supervision Authority (KNF), the National Broadcasting Council (KRRiT) and the President of UKE (electronic communications). The office of the minister for digital affairs provides its administrative support; ministry staff authorised by the commission act independently when carrying out its tasks.

Legal basis: Art. 19, 43 · Dz.U. 2026 poz. 1003

How the chair is chosen

Appointed and dismissed by the Sejm with the Senate's consent, for five years. The Senate has one month from receiving the Sejm's resolution; if it does not vote in that time, consent is deemed given.

Legal basis: Art. 28 · Dz.U. 2026 poz. 1003

Individual opinions

A company subject to the AI Act, or planning activity that will bring it into scope, can ask how the rules apply to its facts or plans. Fee: 150 zł. Deadline: 30 days, 60 for particularly complex cases. If KRiBSI misses the deadline, the opinion is deemed to agree with the position in the request and the fee is refunded. The same company can file a new request only 30 days after its previous one. The opinion binds KRiBSI and other state bodies for that case, and a later change cannot harm the company that asked. Opinions are published anonymised in KRiBSI's Public Information Bulletin (BIP).

Legal basis: Art. 8–13, 15, 17 · Dz.U. 2026 poz. 1003

Inspections

Opened on KRiBSI's own initiative, at the request of a commission member, or at the request of a national authority protecting fundamental rights (Art. 77 AI Act). An inspection can start no earlier than 7 days after the notice is delivered and is carried out remotely, without both sides being physically present.

Legal basis: Art. 49 · Dz.U. 2026 poz. 1003

Fines

KRiBSI applies the AI Act's fine tiers: up to €35M or 7% of worldwide turnover for prohibited practices, €15M or 3% for most other duties, €7.5M or 1% for misleading information to authorities. For SMEs the lower of the two amounts applies.

Legal basis: AI Act Art. 99 · EU AI Act, Article 99

Regulatory sandbox

Participation is free for micro, small and medium-sized enterprises.

Legal basis: Art. 93 · Dz.U. 2026 poz. 1003

What it must publish

Anonymised individual opinions and explanations in its BIP; notices about changes in the law and in EU guidance; by 31 March each year, information with examples of good practice. It also keeps a register of complaints.

Legal basis: Art. 6, 17 · Dz.U. 2026 poz. 1003
